General terms and conditions

  1. General
     
    • These general terms and conditions, (the “General Terms”), apply when you as a consumer, (“you”), order goods or services on Lee New Store and thereto related pages, (jointly the “Website”).  Contact information and other information about us is available on the Website and in Clause 14 below. These General Terms apply only when you as a consumer place an order on the Website.

    • You may only use the Website and place orders if you (i) are 18 years or older, (ii) are not under guardianship. We reserve the right, in each case, to refuse your order (e.g. if you have provided incorrect personal data or have any record for non-payment of debt).

    • We have no liability for products being sold out or any image or typographical errors on the Website, e.g. errors in product descriptions or technical specifications, inaccurate prices and price adjustments (e.g. due to changed pricing by suppliers or changes in exchange rates) or incorrect information on stock levels. We reserve the right to rectify any such errors and to change or update the information provided on the Website at any time. If the wrong price has been provided for a product that you have ordered, we will notify you and await your approval of the amended price before we continue with the order process. Any image details on the Website shall be considered as illustrations only. Such illustrations are not guaranteed to reflect the exact number of products that you receive nor its exact appearance, function or origin. We are not responsible for any information provided by third parties on the Website.

    • We or our licensors own the Website and its content. The information is protected by law, This means that trademarks, company names, product names, images and graphics, designs, layouts and information on products, services and other content published on the Website may not be copied or used without our prior written consent. You may not use the Website for illegal or commercial purposes. You may only use the Website as provided in these General Terms. The Website and its content may not be copied, changed or distributed in any way without the prior written consent of Lee New Store. You may not use any of the software used in the operation or provision of the Website, except when using the Website in accordance with these General Terms.

  2. Contracts and orders

    • You must accept these General Terms in order to place an order on the Website. By accepting these General Terms, you undertake to comply with the General Terms in their entirety.

    • When placing an order on the Website, a purchase agreement is entered into when we have confirmed your order in writing and you have received our order confirmation by e-mail. We ask you to save the order confirmation for any correspondence with our customer services.

    • We strive to provide you with an order confirmation as soon as possible after we have received your order. If an order is placed on a Friday, on the weekend or during a holiday, it may affect the time it takes to provide you with an order confirmation.

  3. Customer information etc.

    • We recommend that you register a user account before shopping on the Website. When you register a user account and/or place an order on the Website, we will ask you to provide certain personal data. You are responsible for ascertaining that the information provided is correct and complete, and for any incorrectly provided information. Further information about how we process your personal data can be found in our Privacy & Cookie Policy.

    • Our products may be subject to certain restrictions, such as age limits. If so, you must be prepared to provide information necessary to confirm that the restricting conditions are fulfilled, either to Lee New Store or to a third party, e.g. a supplier.

    • You must ensure that no unauthorised person is able to use your login details. You may not disclose your username and password to any unauthorised person and must ensure that documents containing your username and password are kept in such a way that unauthorised persons cannot gain access to the information. If you suspect that any unauthorised person has obtained access to your password, you must notify us immediately.

    • We reserve the right to refuse access to your user account without prior warning if we suspect that you are misusing your user account or your login details, or otherwise are in breach of these General Terms. We also reserve the right to provide you with new login details, for any reason.

  4. Prices and payment

    • Prices indicated on the Website apply to orders placed on the Website (subject to Clause 3 above). The prices do not include shipping fees, which are provided separately.

    • You can pay for your purchase using the payment methods specified on the Website. Lee New Store may charge you in connection with your order. We reserve the right not to always offer all payment methods and to change payment method, if for any reason the one you have chosen does not work at the time of the purchase.

    • The Website applies encryption, such as Secure Sockets Layer, (“SSL”), for the protection of your information during data transmissions. SSL encrypts order information such as name, address and payment information.

  5. Special offers

From time to time, Lee New Store may provide special offers on the Website which may apply more favourable terms than those provided for in these General Terms. These more favourable terms will apply only for the duration of the special offer and only for the specific products mentioned in connection to it. We reserve the right to cancel special offers at any time. Upon termination of or withdrawal from a special offer, these General Terms shall apply without any amendments. Any offers for specific products on the Website are valid only for a limited period of time and until the products are sold out.

  1. Shipping and delivery

    • Products in stock are normally delivered within the number of working days set forth on the Website and in the order confirmation. If a delivery is delayed, we will inform you accordingly and continue to monitor the order. Unless otherwise expressly agreed (e.g. by information that the product is sold out) and if a delivery is delayed for more than 30 business days from your receipt of the order confirmation, and it is not because of you, you are entitled to cancel the purchase.

    • If a package is to be picked up at a specific delivery point, you shall collect it within the time specified in the notification. Normally, packages shall be picked up personally by providing a valid ID along with order number/parcel number. You will always receive a delivery notice stating when and where the package shall be picked up. The notice may be sent by e-mail, mail or, if you have provided a mobile phone number, by SMS.

  2. Cancellation of orders

    • If you wish to cancel an order, you may request a cancellation.

    •  However, if we are not able to receive and process your cancellation request before we confirm your order, your cancellation request may not be effective. You do, however, still have a right of withdrawal in accordance with Clause 8

    • The right of cancellation does not apply to digital content (including digital software and games) once the digital content becomes available for download or a digital code has been issued that makes such digital content available for download.

    • If you cancel your order in accordance with these General Terms, any payments made in regard to the order will be refunded.

  3. Right of withdrawal

    • When purchasing products on the Website, you are entitled to a 14-day withdrawal period in accordance with applicable consumer protection legislation. This means that you have the right to cancel any purchase by notifying us accordingly within 14 days of you, or your representative, receiving the product (the withdrawal period).

    • The right of withdrawal does not apply to the following products:
  • any products made to your specification or that otherwise have been given a clear personalised character;
  • any sealed audio- or image recordings, games or computer programs (including technical seals by e.g. serial numbers) with broken seals; or
  • any digital content that has been supplied in any other form than on a tangible medium (e.g. computer programs, applications, games, music, videos or texts where access is by means of downloading or streaming).
  • Lee New Store + Loyalty cards cannot be refunded after purchase.

  • By accepting the General Terms, you acknowledge and agree that the electronical delivery of digital content may be initiated before the expiry of the withdrawal period and that the right of withdrawal is not valid for any digital content delivered otherwise than by tangible mediums.

  • Please send us a clear message by mail or e-mail, using the contact information provided in Clause 14 below, before the withdrawal period expires, if you wish to withdraw a purchase. You must provide your name, address and other relevant information, e.g. order number, invoice number and name of the product in the message.

  • If you use your right of withdrawal, you must bear the costs for returning the products. Furthermore, you are responsible for the condition of the product from when you have received it and during the shipping back to us. We recommend that the product is sent in return well packaged, in good condition and in its original box . The product shall be returned within 14 days from the date when we received your notification informing Lee New Store that you want to exercise your right of withdrawal.

  • For orders cancelled by using your right of withdrawal, we will issue you with a full refund, including the shipping costs for sending the product to you. Any additional shipping costs due to you choosing another delivery than our standard delivery are exempted from the refund. When you return part of an order, the shipping costs will not be refunded. We are entitled to deduct an amount from the amount to be refunded which corresponds to the diminished value of the product compared to the original value, if and to the extent the loss of value is due to you handling the product negligently or to a greater extent than what is necessary to determine its function or characteristics.

  • We will refund the amount as soon as possible, but not later than within 14 days of the date when we received your notification of withdrawal. However, we may delay the refund until we have received the product or until you have provided proof that the product has been returned, e.g. by a certificate of delivery. Refunds will be made by the same payment method you chose, unless otherwise agreed or the method is unavailable.
  1. Warranties and complaints

    • Some of our products may be subject to warranties. Information about any warranty period and special conditions for warranties for each product is set forth on our Website. Warranties for products will only cover manufacturing defects, and thus not any fault arising due to negligent or abnormal use, or after any individual changes of the product’s function and appearance, e.g. rebuilding, upgrading or other configuration of the product. Your order confirmation constitutes the certificate of warranty.

    • You are always entitled to lodge complaints for products bought on the Website within a reasonable time from discovering the defect or from the time you should have discovered the defect. The right to lodge a complaint applies to products that are defective according to applicable consumer protection legislation. If you wish to lodge a complaint for any product ordered, you shall contact us through the contact details provided in Clause 14 as soon as possible after discovering the defect. Complaints made within two months from you discovering the defect will always be considered as having been given in due time.

    • We will rectify or replace a defective product, or refund you for such product, in compliance with applicable consumer protection legislation once a product, for which a complaint has been lodged, is returned and the complaint approved. Even though we strive to do so within 30 days from receipt of your complaint, it may be delayed depending on the nature of the product and the matter process. We will carry the cost for the return freight for any approved complaints. We reserve the right to refuse a complaint if the product proves not to be defective in accordance with the applicable consumer protection legislation. 

  2. Force majeure

Unless otherwise is provided under mandatory law, Lee New Store is not liable for defects or delays caused by circumstances beyond our reasonable control, such as general labour disputes, war, fire, lightning, acts of terrorism, amendments to regulations issued by governmental authorities, issues with power mains or telephone communications, data transmissions or any other form of communication, and defects or delays in deliveries by sub-contractors caused by any such circumstance as referred to in this Clause. 

These circumstances release us from liability in damages and any other penalties. If such circumstances should occur, we will inform you of its commencement and cessation. If these circumstances last for longer than two months, both Lee New Store and you have a right to cancel the purchase with immediate effect.

  1. Limitation of liability

    • Unless otherwise provided in these General Terms, the liability of Lee New Store is limited to what is provided under mandatory law. This applies regardless of how the damage or loss is caused (including damage or loss caused by negligence) and regardless of if the damage was foreseeable or not when entering into the agreement (even if Lee New Store has been informed of the risk of such damage or loss).

    • The Website may include links to other websites or resources, and to businesses operated by other persons. These other websites are not operated or controlled by Lee New Store. Accordingly, Lee New Store is not responsible for, and will have no liability for, these other websites, their business, goods, services, or content. If you link to or use any of these other websites, your dealings with the owners or operators of these websites is at your own risk, and you agree that you will not make any claim against Lee New Store arising from your use of any of these other websites.

  2. Changes to the General Terms

We reserve the right to change these General Terms at all times. Changes will become valid when published on the Website and only for orders made thereafter.

  1. Governing law and disputes

    • If a dispute should arise between you and Lee New Store that we have not been able to settle together, you may as a consumer file a complaint with the Competition and Consumer Protection Commission.  You can contact the Competition and Consumer Protection Commission.

 

14. Errors and Product Availability; Offers to purchase

Errors, misprints and omissions (including incorrect prices, descriptions or specifications for products) may sometimes occur. Lee New Store does not guarantee that products and services advertised on our Website will be available when ordered or thereafter. Lee New Store makes no representation or warranty that the content of the Website, including product descriptions or photographs, is accurate or complete.

In addition and supplementary to the provisions of the Purchase Terms and Conditions stated below, Lee New Store may at any time, without any prior notice or liability to any Website user (a) correct any error, inaccuracy or omission; (b) change the products and services available on the Website, or the prices, fees, and specifications of such products and services, or any promotional offers and any other Website content; and (c) limit quantities available for sale.

Unless otherwise noted, all promotional offers, bundles, and deals shall be limited to one per customer. Lee New Store reserves the right to cancel and subsequently refund any order or orders which do not abide by this condition of purchase.

The advertisements on the Website are invitations to you to make offers to purchase products and services on the Website and are not offers to sell.

15. Refunds and Returns

When you receive your package, you should examine it closely before opening the factory sealed product packaging to determine that it is what you ordered. If you are not satisfied with your order, you may exchange or return your product at any Lee New retail store We also accept returns by mail for orders that were shipped directly to you. The returned product should be returned in the same condition as when you purchased it, with all manuals, accessories, and the packing slip.

Should you change your mind about your order, we will accept return within 14 days after you receive your order.

We would be pleased to exchange or give you a refund in-store on most items you buy online, up to 30 days after your receive your order. We will exchange game consoles up to 14 days after you receive your order.

Due to copyright laws, computer and game console software, music CDs, DVDs and videos in opened packages may only be exchanged for the same item. Shipping and handling charges are non-refundable; however, we will refund your original shipping cost if you are returning a defective item, if required by law, or because of an error on our part.

The right of return does not apply to digital content (including digital software and games) once the digital content becomes available for download or a digital code has been issued that makes such digital content available for download. By making a purchase of digital content on the Website you agree that the digital content is available to you for download immediately, and you acknowledge that as a result you waive any statutory rights to cancel or withdrawal your order or return the digital content.

All products (whether defective or non-defective) must be returned in their original purchase condition, with the original packing material, blank warranty cards, manuals and any other item or accessory provided by the manufacturer. IMPORTANT: If a returned order has items missing, the order may be refused, or the value of the missing materials may be deducted from the total credit amount.

On purchases made with a credit card, only the same card used to make the purchase will be credited with the refund. The credit will be made within 7 business days of us receiving and verifying the returned merchandise.
